TERMS OF USE/DISTANCE AGREEMENT
Terms of Use/Distance Agreement
When placing an order in the online store www. avcosmetics.lv , in accordance with the first and second parts of Article 10 of the Consumer Rights Protection Law, a civil law agreement or distance contract is concluded between you as a consumer and the owner of the online store www. avcosmetics.lv, IK VAAV, as the seller.
DISTANCE CONTRACT
This contract is concluded between the company IK VAAV Reg. No. LV40002192424, legal address: "Trešelnieki-2", Vircavas parish, Jelgava municipality, LV-3036, and the buyer who makes a purchase in the www. avcosmetics.lv online store.
Explanation of terms used in the contract:
Buyer: Buyer within the meaning of this Agreement is a person who makes a purchase in the www. avcosmetics.lv online store. Buyer is a person who makes a purchase without commercial purposes. If you are not a Buyer within the meaning of this Agreement, please do not make a purchase! Persons who wish to purchase the goods offered by us for commercial purposes are invited to contact us by writing to the e-mail address: info@avcosmetics.lv.
Distance Agreement: The Agreement between the Buyer and IK VAAV is automatically concluded as soon as the Buyer places an order. By placing an order in the www. avcosmetics.lv online store, you confirm that you have read this “Distance Agreement” (hereinafter referred to as the Agreement) and fully agree to the terms of this Agreement. The Agreement imposes mutual obligations and duties.
1. ORDERING THE PRODUCT
1.1. When placing an order in the online store www.avcosmetics.lv , the Buyer receives an automatically generated order confirmation/invoice to the specified e-mail address. In case the Buyer has not received the order confirmation from the online store www.avcosmetics.lv to the specified e-mail address, please contact us by writing to: info@avcosmetics.lv or by calling: (+371) 22322632 to make sure that the order has been registered;
1.2. Within 3 business days after confirming the order, the Buyer will receive comments on the progress of the order, or alternative offers of goods in cases where the ordered goods are not available, to the specified e-mail address.
2. GOODS AND THEIR PRICES
2.1. Prices of goods are indicated in EUR, including VAT.
2.2. The delivery price is not included in the price of the product.
2.3. Delivery prices and procedures are specified in the "Delivery" section.
3. PAYMENT PROCEDURE
3.1. The methods and procedures for paying for goods are specified in the "Payment" section.
4. ORDER FULFILLMENT PROCEDURE
4.1. The terms and procedure for completing an order depend on the payment and delivery method, as well as the selected product. Order fulfillment terms are explained in the “Delivery” section.
5. BUYER'S RIGHTS (including the right of withdrawal)
5.1. The Buyer has the right to choose and purchase goods in the online store www.avcosmetics.lv both as a registered and unregistered customer;
5.2. The Buyer has the right to choose any of the offered delivery methods;
5.3. The buyer has the right to refuse and return the delivered goods:
5.3.1. The buyer has the right to return the purchased goods within 14 days from the moment of receipt of the goods, by sending or personally delivering them to the actual address of IK VAAV: Jelgavas iela - 4, Vircava, Vircava parish, Jelgava region, LV-3020;
5.3.2. The Buyer is responsible for maintaining the quality and safety of the product during the period of exercising the right of withdrawal;
5.3.3. The Buyer's claims shall be considered unfounded in relation to defects in the goods that have arisen as a result of the Buyer's careless attitude (e.g., mechanical damage);
5.3.4. When returning the goods, the Buyer covers all expenses related to the return of the goods;
5.3.5. If the Buyer exercises the right of withdrawal in the event of a defective or non-conforming product, all expenses related to the return of the product shall be covered by IK VAAV;
5.3.6. The Buyer has the right to receive the money paid for the goods if the Buyer has fulfilled the following terms and conditions for returning the goods:
5.3.6.1. the Goods Cancellation Form has been completed and sent;
5.3.6.2. Within 7 days of submitting the withdrawal, the unused product in the original packaging and with all original labels has been sent or personally delivered to the actual address of IK VAAV: Jelgavas iela 4, Vircava, Vircava parish, Jelgava municipality, LV-3020;
5.3.6.3. In the event of a defective or non-conforming product, a receipt for the return shipping costs must be attached when sending the product by mail;
5.3.7. If the Buyer has complied with all the rules related to the return of the goods, then within 14 working days after receiving the returned shipment, but no later than 30 days from the date of receipt of the Buyer's written refusal, IK VAAV shall refund the value of the goods to the Buyer's bank account, without refunding the delivery costs. IK VAAV has the right to withhold the refund until IK VAAV has received the goods back or until the Buyer has submitted proof that the goods have been sent back, depending on which action is performed earlier.
5.4. Right to cancel the order :
5.4.1. The buyer has the right to refuse the order if IK VAAV has not met the specified or cannot meet the desired delivery times for the goods;
5.4.2. In the event that the Buyer cancels the order during the delivery of the goods, the Buyer is obliged to cover the delivery costs.
5.4.3. The consumer cannot return the product if:
5.4.3.1. the provision of the service, which was initiated before the expiration of the right of withdrawal period, has been fully completed, if the consumer has expressly agreed and confirmed that he will lose the right of withdrawal from the date on which the contract for the provision of the service has been fully performed;
5.4.3.2. the product is manufactured according to the consumer's instructions or the product is clearly personalized;
5.4.3.3. the consumer has opened the packaging of a product that cannot be returned for health and hygiene reasons;
5.4.3.4. the product, due to its properties, has been irreversibly mixed with other things after delivery;
5.4.8. the consumer has purchased a product that requires certain storage conditions (limitations on humidity, light, temperature, etc.).
6. BUYER'S OBLIGATIONS
6.1. The Buyer is obliged to carefully familiarize himself with the Distance Agreement and other rules relating to the procedure for ordering, payment, delivery and return of goods and to assume responsibility for failure to comply with the rules;
6.2. The buyer, when registering as a www.avcosmetics.lv client, is obliged to fill in all specified fields;
6.3. The Buyer is obliged to provide true information about himself when filling out the registration form, as well as the form to be filled out when placing an order;
6.4. The Buyer is responsible for the accuracy of the information provided and any legal consequences that may arise for either party to the contract in the event of providing false information;
6.5. The Buyer is responsible for the accuracy of the information provided. IK VAAV does not assume responsibility for cases where the product ordered by the Buyer is not delivered to the Buyer due to inaccurate information provided;
6.6. Prohibitions: Buyers and any other visitors to the online store www. avcosmetics.lv are strictly prohibited from:
6.6.1. copy, store, archive and fully or partially publish photographs published on www. avcosmetics.lv , as well as republish any information without reference to www. avcosmetics.lv ;
6.6.2. use any automated means to access information on the store's www.avcosmetics.lv server;
6.6.3. collect, copy and otherwise obtain data about other Buyers;
6.6.4. take circumvention measures to prevent or restrict access to www.avcosmetics.lv ;
6.6.5. intentionally create a disproportionate load on the IT infrastructure of www.avcosmetics.lv or interfere with the successful operation of www. avcosmetics.lv ;
6.6.6. post information containing viruses or other technologies that harm the interests and property of www. avcosmetics.lv and its users. IK VAAV will report any violation of the above prohibitions to the relevant authorities, and also reserves the right to deny further access to the online store www. avcosmetics.lv to a person suspected of violating the prohibitions.
7. RIGHTS AND OBLIGATIONS OF THE IK VAAV
7.1. IK VAAV offers its Buyers high-quality goods. In the event of a defect, IK VAAV is obliged to refund the Buyer the value of the goods he paid, as well as the costs of returning the goods;
7.2. IK VAAV offers its Buyers convenient delivery terms. If IK VAAV has not met the specified delivery terms, IK VAAV apologizes and gives the Buyer the right to refuse the order (except in cases where the delivery is delayed due to the actions of Latvijas Pasts or another courier service provider);
7.3. IK VAAV highly values the trust of Buyers, therefore undertakes to ensure a high level of personal data protection, as well as not to disclose the information provided by the buyer to third parties without his consent;
7.4. The products and prices displayed in the online store www.avcosmetics.lv are for informational purposes only. Prices and product offerings may be changed without notice;
7.6. The appearance of the product (color nuances) may differ from that shown in the catalog;
7.7. IK VAAV reserves the right not to process orders in cases where there is suspicion that the Buyer is not a Buyer within the meaning of this agreement and is purchasing goods for commercial purposes;
7.8 IK VAAV has the right to change and supplement these terms and conditions and the Agreement. The changes shall enter into force from the moment of their publication on the website www.avcosmetics.lv and shall apply to orders for goods placed after the publication of the changes.
